The Florida Supreme Court affirmed that smoking indeed causes cancer, that nicotine is addictive, and that Big Tobacco has suppressed this knowledge while continuing to mislead the public about the potentially lethal dangers of smoking. The Court overturned punitive damages previously awarded by a jury in a class action lawsuit. However, in a bond agreement reached prior to the appeal with three of the Big Tobacco companies, a pool of $710 million was set aside for recovery through individual lawsuits. Victims and family members who were parties to the class action lawsuit, and smokers who became ill with smoking-related cancers or obstructive pulmonary disease between 1990 and 1999, may have a legal right to recovery from this pool of money.
