Despite regulations, caution, and common sense, each year unsafe products injure thousands of people. Searcy Denney helps them seek justice.

Americans have learned the hard way to be cautious about the products they buy. Thanks to giant corporations that put their profits over your safety, there are thousands of defective or harmful products on the market. The range includes defectively-designed SUVs with roofs that crush occupants in rollovers; toys with tiny parts that can be swallowed, or lead paint that can poison toddlers; so-called health foods and herbal supplements that can cause organ failures; pharmaceuticals that kill rather than cure; toxic chemicals that seep into our air and water; and cigarettes that cause lung cancer and other serious conditions.

The battle against unsafe products is being waged by the Federal government and state legislatures, by consumer watchdog and advocacy groups . . . and by the attorneys at Searcy Denney Scarola Barnhart & Shipley, who have sought justice for families devastated by death and injuries because of unsafe products.

Federal agencies that regulate and enforce safe product standards include the Consumer Product Safety Commission, which safeguards consumers from fire, electrical, chemical and mechanical hazards from 15,000 kinds of products. CPSC estimates that deaths, injuries and property damage from unsafe products cost our economy about $800 billion each year. This agency has recalled nearly 400 million products since its inception . . . but some manufacturers nonetheless continue to flood the market with safety defects.

The National Highway Traffic Safety Administration enforces Federal Motor Vehicle Safety Standards, such as mandatory seat belts and air bags, roof strength minimums for cars and SUVs, and electronic stability control requirements.  Many consumer groups, however, have been critical of NHTSA’s record and are engaged in an ongoing effort to lobby Congress for stronger motor vehicle safety standards and greater enforcement.

A third Federal agency, the Food and Drug Administration, is the gatekeeper for protecting our food, approving drugs and medical devices that are safe and effective, monitoring blood supplies and vaccines, safeguarding pets and farm animals, and making sure cosmetics are not harmful. In recent years, there has been an epidemic of FDA recalls of pharmaceuticals that have killed hundreds of people before the agency took notice. The FDA is under fire for approvals based on fraudulent testing and reporting by big pharmaceutical companies who put their profits over consumer health and safety.

At Searcy Denney Scarola Barnhart & Shipley, we believe we are a necessary and important link in this chain of protection against unsafe products that cause death and devastating injuries. That’s because we take action against the negligent manufacturers of these products – whether against an automaker marketing defective SUVs or the manufacturer of camping heaters that emit potentially-lethal carbon monoxide.

If a loved one has died, or you or a family member has been injured, because of an unsafe product, the attorneys at Searcy Denney can help you chart the path to seeking justice. Please fill out our Contact Form, or call us to learn more and arrange for a confidential free consultation.
